EC Calls on Hungary to Comply With CJEU Ruling on Asylum Seekers

The European Commission on Wednesday said it decided to send a letter of formal notice to Hungary, marking the launch of an infringement procedure, for failing to comply with a ruling by the Court of Justice of the European Union (CJEU) regarding asylum rules, according to a report by state news wire MTI.

In the ruling of June 22, 2023, the CJEU said Hungarian legislation requiring asylum seekers to submit applications at an embassy in a third country failed to comply with an EU directive on common procedures for granting international protection.

The EC said it had not been informed of any remedial measures taken by Hungary following the CJEU decision.

Hungarian authorities have two months to respond to the letter of formal notice or the EC may decide to refer the case back to the CJEU and propose the imposition of financial sanctions.
